J Am Med Assoc. 1940;115(12):1048: Medical Practice Acts: Surgical Diathermy by Naturopath Constitutes Unlawful Practice of Medicine. The defendant, a licensed naturopath, removed "a lump or growth," which he diagnosed as "cancer," from the bottom of Mrs. Larkin's right foot by cauterization with "a surgical diathermy" apparatus, an apparatus commonly used by surgeons. ... For the performance of this procedure the naturopath was convicted of practicing medicine without a license, in violation of the Arizona medical practice act, and was sentenced to the penitentiary. He then appealed to the Supreme Court of Arizona. ... For the reasons stated above, the judgment of conviction was affirmed.—-Nethken v. State (Ariz.), 104 P. (2d) 159.
